Terms and Conditions
Please read this license agreement carefully before subscribing to/using Bulletin of Marine Science (BMS) electronic journal access. By accessing BMS electronic journals, you are agreeing to be bound by the terms of this license.
1. Scope of License
Individual/Institutional Subscriber Use Restrictions: The subscription includes
authorization by means of a unique username and password that may only
be used by the individual subscriber.
The subscription entitles an individual or institutional subscriber access to the Bulletin of Marine Science electronic journals to:
a. make searches.
b. make one or more copies in printed form of the output of any search; such copies may not be sold or distributed to anyone who is not an authorized user.
c. download search results to hard disk, diskette or any other media, provided that such data are not made available to anyone who is not an authorized user.
Any copies of articles must maintain all copyright and other notices on the printed and electronic articles.
The downloading of an entire journal issue, regular or special issue, or complete journal volume in a systematic fashion is strictly prohibited.
PDF files for use by authors for distribution purposes must be purchased separately.
An individual or institutional subscriber may not make BMS electronic journals available to anyone else by any means, whether telephone link, internet connection, permitting access through his or her terminal or computer, or by other means or arrangements.
The subscriber is solely responsible for all security and use, including unauthorized use, of the subscriber’s username and password.
Institutional Subscriber Use Restrictions: The subscription includes authorization by means of the subscriber’s IP address or range of IP addresses to allow access to authorized users via multiple connections. If a proxy server is being registered for access, the subscriber agrees to maintain the security of the access by authenticating authorized users before allowing use of the proxy to any remote or on-site user.
Authorized users must be employees, faculty, staff or students officially affiliated with the subscriber, or authorized on-site patrons of the subscriber’s library facilities. For academic institutions, different campuses are treated as different subscribers even if they are within the same city. Departments or libraries of the same campus are treated as part of the same subscriber. For nonacademic institutions, subscribers are defined as geographically separate units, even if they are within the same city. Each branch, office or laboratory is considered a different subscriber.

Interlibrary loans are restricted to academic libraries for educational purposes and must be made in compliance with Section 108 of the Copyright Act of the U.S. and within the CONTU guidelines. Electronic transmission of journal articles must not be done so in such quantities that may substitute for a subscription.
2. Term and Fees
Subscriptions last through the end of the calendar
year in which they become effective. This agreement will remain in
effect thereafter for successive calendar years so long as the annual
subscription fees are paid. Either party may terminate this agreement
with 30 days written notice to the other party. The annual fee for the
subscription may be raised with written notice to the subscriber, prior
to the renewal date. A subscription includes online access to the
current year’s issues and all available online back issues. Once the
subscription is terminated, BMS will provide the subscriber with
electronic copies of all issues published during the term of the
subscription.
3.Support
The BMS will provide the subscriber with e-mail
and/or telephone support during BMS’s normal business hours
(Monday–Friday, 8:00 a.m. to 4:00 p.m. EST, excluding holidays). The

4.Copyright
BMS electronic journals and their contents are
subject to copyright, database protection, and other rights of the
publisher (BMS) under the laws of the United States and the country of
use. Any use of material in the BMS’s collection that is determined to
be “fair use” under U.S. law (Section 107 and Section 108 of the U.S.
Copyright Law) does not require permission. Republication, systematic
reproduction, posting in electronic form on servers, or other uses of
this material, requires written permission or license from the BMS.
5. Suspension or Termination of Access
The BMS reserves the right to suspend and/or
terminate access to the BMS electronic journals without prior notice if
subscriber violates any term of this agreement. Any use of the
electronic journals beyond the scope of the agreement or any fraudulent,
abusive, or otherwise illegal activities may be grounds for termination
of access.
